1. Acceptance of these terms
These Terms & Conditions ("Terms") govern your use of the KisanYantra mobile application, website, and related services (together, the "Platform") operated by KisanYantra ("KisanYantra", "we", "our", "us"). By creating an account or using the Platform you accept these Terms and our Privacy Policy. If you do not accept, you may not use the Platform.
2. Eligibility
- You must be at least 18 years old.
- You must be an Indian resident with a valid mobile number and government-issued ID.
- You must not be barred from using the Platform under any applicable law or a prior termination by us.
- You must have legal authority to enter contracts on behalf of any business or HUF you represent.
3. Your account
- Provide accurate, current information at registration and keep it updated.
- Safeguard your mobile number and any one-time passwords (OTP) used to log in.
- Notify us immediately at support@kisanyantra.in if you suspect unauthorised access.
- Do not impersonate another person or share your account with anyone else.
4. Our role on the Platform
KisanYantra is an intermediary as defined under the Information Technology Act, 2000. We provide the technology that lets farmers, equipment owners and operators discover each other and agree on rentals. Each rental contract is a direct agreement between the renter, the owner, and (where applicable) the operator. We are not a party to that agreement.
We do not own, lease, manufacture, transport, operate, repair or insure the equipment listed on the Platform. We do not employ the operators. We do not collect or hold money — payments are settled directly between the parties via cash or UPI, outside the Platform.
5. Renter terms
5.1 Booking and confirmation
A booking is created when you submit a request and the owner accepts. You are committing to pay the agreed amount for the equipment and dates specified.
5.2 Cancellation
You may cancel before the cancellation cut-off shown on each listing (typically 24 hours before start time) without penalty. Cancellations after the cut-off may forfeit any deposit you have agreed with the owner.
5.3 Damage and loss
You are responsible for any damage to or loss of the equipment during the rental period that is caused by your or your operator's negligence or wilful conduct. Normal wear and tear is the owner's responsibility.
5.4 Use restrictions
Use the equipment only for the purpose for which it is designed, in lawful agricultural operations, and only on the property or routes you are authorised to use.
6. Owner terms
6.1 Listing accuracy
You must list equipment you own or are legally authorised to rent. Photos, brand, model, HP, condition, included implements and pricing must be accurate and current.
6.2 Availability
Once you accept a booking you commit to delivering the equipment on the agreed dates in the condition listed. Repeated last-minute cancellations may result in account suspension.
6.3 Operator
If your listing includes an operator, you remain responsible for the operator's conduct and credentials, even if you sourced them through the Platform.
6.4 Insurance and compliance
You confirm that the equipment carries any insurance and registration required by law (e.g. tractor RC, valid PUC, third-party motor cover where applicable).
6.5 Tax
You are solely responsible for taxes (GST, income tax) on the rentals you earn. KisanYantra does not collect, deduct or remit tax on your behalf.
7. Operator terms
Operators agree to hold valid licences and credentials for the equipment they operate, to follow the renter's reasonable instructions within the bounds of safe operation, and to maintain courteous conduct. Operators are independent service providers and are not employees of KisanYantra or, unless separately agreed, of the equipment owner.
8. Payments
Payments are settled outside the Platform, directly between the renter and the owner, by cash or UPI. KisanYantra does not collect, hold or remit money. Receipts and payment status visible in the app are user-recorded — KisanYantra cannot verify or guarantee them.
9. Zero-commission promise
KisanYantra does not charge a commission to renters, owners, or operators on the rental amount or operator wages. The Platform is provided free at the point of use.
We may, in the future, introduce optional add-on services (e.g. insurance products, premium listings, advertising) — these will be clearly priced, opt-in, and subject to a separate agreement. The core rent / list / operate flows will remain commission-free.
10. KYC verification
To list equipment, register as an operator, or transact above thresholds set by us from time to time, you must complete KYC. You authorise us and our KYC partners to verify the documents you submit against the relevant authority. Submitting forged or impersonated documents will result in immediate termination.
11. Prohibited use
- Do not use the Platform for anything other than lawful agricultural-equipment rental and related services.
- Do not list stolen, encumbered, or non-functional equipment.
- Do not circumvent the booking flow to avoid the platform's protections (e.g. negotiating off-platform after a connection has been made — beyond the cash/UPI settlement KisanYantra explicitly defers to).
- Do not scrape, reverse-engineer, or interfere with the Platform's operation.
- Do not harass, threaten or defame other users.
- Do not upload viruses, malware, or any code that disrupts the Platform.
12. User content
You retain ownership of photos, descriptions, ratings and other content you submit. You grant KisanYantra a non-exclusive, worldwide, royalty-free, sublicensable licence to display, reproduce and adapt that content solely to operate, promote and improve the Platform. You confirm you have the rights to grant this licence.
13. Intellectual property
The KisanYantra name, logo, app icons, illustrations, software and all related trademarks are owned by KisanYantra. You may not reproduce them without our written permission.
14. Dispute resolution
14.1 In-app first
If a dispute arises with another user, please raise it in the in-app "Help & support" flow first. We will collect both sides' statements and attempt a fair resolution within 14 working days. As we do not handle the money, the resolution may include a recommendation about cash/UPI settlement between the parties.
14.2 Arbitration
Any dispute that remains unresolved after the in-app process, including any dispute with KisanYantra, shall be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be in [City — to be set before public launch], India. Proceedings shall be conducted in English or Hindi.
15. Limitation of liability
To the maximum extent permitted by law, KisanYantra's aggregate liability for any claim arising out of these Terms or the Platform is limited to the greater of (a) ₹10,000 or (b) the platform fees (if any) paid by you in the 12 months immediately preceding the claim.
We are not liable for: (i) loss of profits, goodwill, crops or business opportunity; (ii) damage to or loss of equipment caused by users; (iii) injuries arising from operator / renter conduct; (iv) cash or UPI transactions between users; (v) failure of third-party services (UPI, telecom, electricity); or (vi) events of force majeure.
16. Indemnification
You agree to indemnify and hold harmless KisanYantra and its officers, employees, affiliates and partners from any claim, demand, loss or liability (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your interaction with another user.
17. Termination
You may delete your account at any time from the in-app Profile screen. We may suspend or terminate your account if you breach these Terms, fail KYC, or for any reason required by law, with reasonable notice where practicable. Provisions that by their nature survive termination (sections 12–16, 19) will continue to apply.
18. Changes to these Terms
We may update these Terms as the product or our legal obligations change. Material changes will be notified in-app at least 7 days before they take effect. Continuing to use the Platform after the effective date constitutes acceptance.
19. Governing law
These Terms are governed by the laws of India. Subject to Section 14, the courts at [City — to be set before public launch] shall have exclusive jurisdiction.
